The new Traffic Reform Bill (25th May 2010) has important changes for motorists in Spain. This includes new fines, new offences and more powers to the police. |
|
One of the most important aspects of the new legislation is the legalising of average speed cameras in Spain. These cameras measure the speed of a vehicle at two points and calculate an average speed. Breaking the limit will trigger an automatic fine. |
|
Here are other important changes:
- Handling a navigator while the vehicle is moving is now classed as a SERIOUS offence
- Having an unreadable, bent or dirty registration plate will result in a fine
- Parking in a disabled parking space will result in a fine
- Allowing someone to drive your vehicle without a licence will result in a fine
- Riding a cycle without lights at night will result in a fine
- ITV test stations can demand to see insurance papers before performing an ITV test
- The use of radar detectors is now legal but radar jammers are banned

Loss of points on your licence (Spanish)
Loss of 6 points
- Driving over the legal alcohol limit
- Driving under the influence of drugs
- Refusing a test for drugs/alcohol
- Reckless driving (driving in wrong direction/racing etc)
- Using radar jammers
- Driving more than 50% allowed driving time for HGVs
- Altering/fixing a tachograph or speed limiter

Loss of 4 points
- Driving a type of vehicle not permitted on your licence
- Throwing objects out of your window that could cause fires or obstructions on the highway
- Failing to comply with road signs for give way, stop or traffic lights
- Endangering traffic coming in the opposite direction and overtaking in poor visibility
- Endangering cyclists when overtaking
- Reversing on motorways or dual carriageways
- Failing to obey a traffic officer
- Failing to keep a safe distance
- Driving a vehicle when banned/not permitted to do so

Loss of 3 points
- making a U turn where not permitted
- Driving whilst wearing earphones, handling a mobile phone or navigator
- Not wearing a seatbelt, safety helmet or having adequate child seats

Mobile telephones
The use of a mobile telephone, other than a true hands-free, whilst driving is now banned in Spain, even at the side of the road. You have to pull off the road completely away from any traffic. You may also not have any device in your ears to listen to music or your mobile phone etc., only allowed is something for enhancing your hearing, i.e. a deaf-aid. Sadly, you still see erratic driving where a mobile is in use, but penalty points can now be awarded.
Navigation aids and DVD´s etc.
The law has now been changed and clarified regarding sat navs - You can have them installed (including speed camera detectors) but you must not touch the unit whilst the vehicle is moving
